Terms of Service

1. Overview

getdesign.md ("the Service") is operated by the VoltAgent team ("we", "us", "our"). By accessing, browsing, or purchasing from the Service, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

getdesign.md is a browsable directory of DESIGN.md files, structured markdown files that document independent analyses of publicly observable design patterns. The Service also offers the following paid digital products:

  • DESIGN.md inspiration: A tailored DESIGN.md purchased from a specific entry in the public inspiration directory.
  • Private DESIGN.md request: A custom DESIGN.md generated from a website URL you submit, never published in the public directory.
  • Website Starter Kit: A production-ready website starter codebase, delivered alongside your private DESIGN.md file and AI playbooks.
  • Mobile Starter Kit: A complete Expo and React Native source-code foundation with prebuilt mobile flows, sample data, a design system, and setup guides for AI coding assistants.

The Service also operates an Affiliate Program through which approved participants may recommend eligible products and earn commission on Qualified Sales.

3. Eligibility

You must be at least 16 years old and able to form a binding contract in your jurisdiction to use the paid features of the Service. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

4. Acceptance of Terms at Checkout

When you complete a checkout, you confirm that you have read and agree to these Terms and to our Privacy Policy. Completion of payment through Stripe constitutes affirmative acceptance of these Terms at the time of purchase.

5. Free Content

All DESIGN.md files available in the public directory are free to browse, download, and use in your projects. These files are provided "as is" without warranty of any kind. They are curated starting points based on independent analysis of publicly visible design patterns and are not official design systems from the listed companies.

6. Paid Products

All prices are in US dollars and shown at checkout before you pay. Prices vary by product and item and may change at any time. The amount displayed at checkout is the price that applies to your order, and all payments are processed by Stripe.

6.1 DESIGN.md inspiration

  • Price: The price shown at checkout for the selected website-directory entry, charged via Stripe at the time of purchase. Prices vary by item and may change at any time; the amount displayed at checkout is the price that applies to your order.
  • Delivery: A DESIGN.md (light + dark), token preview HTML files, and a private Discord invite delivered to the email you provide within 1 to 2 business days.

6.2 Private DESIGN.md request

  • Price: The price shown at checkout for your request, charged via Stripe at the time of purchase. Prices vary and may change at any time; the amount displayed at checkout is the price that applies to your order.
  • Delivery: A DESIGN.md tailored to the website URL you submit, plus light and dark preview HTML files and a private Discord invite, delivered by email within 1 to 2 business days. Never published in the public directory.

6.3 Website Starter Kit

  • Price: The price shown at checkout, charged via Stripe at the time of purchase. Prices vary and may change at any time; the amount displayed at checkout is the price that applies to your order.
  • What you get: Everything in the private DESIGN.md tier, plus a full production-ready website starter codebase. Your DESIGN.md is delivered alongside the codebase rather than baked into it, so you can apply it to the site with a prompt, together with AI playbooks (skills) for the tools wired into the kit.
  • Delivery: A download link and setup instructions sent to the email you provide within one business day.

6.4 Mobile Starter Kit

  • Price: The price shown at checkout, charged via Stripe at the time of purchase. Prices may change at any time; the amount displayed at checkout is the price that applies to your order.
  • What you get: The complete Expo and React Native source code, the included design system, prebuilt screens and flows that run with sample data, and setup guides that help compatible AI coding assistants customize the project and connect supported services.
  • Delivery: A ZIP download link and setup instructions sent to the email you provide within one business day.
  • Third-party services: Live authentication, databases, payments, analytics, crash reporting, AI features, builds, and store distribution may require accounts, credentials, approvals, usage fees, and subscriptions from third-party providers. These are not included in the purchase price unless expressly stated at checkout.

6.5 Refunds

  • Digital product: All products above are digital goods delivered electronically. Once the files, repository access, or download link have been delivered, all sales are final, except where applicable law requires otherwise.
  • Delivery failure: If we are unable to generate a DESIGN.md or deliver a Starter Kit you purchased, you will receive a full refund.
  • EU/UK right of withdrawal: By purchasing a digital product and requesting immediate delivery, you expressly consent to immediate performance and acknowledge that you lose your statutory right of withdrawal under applicable EU and UK consumer protection law once delivery has begun.

7. Acceptable Use

You agree not to use the Service, the generated DESIGN.md files, or either Starter Kit to:

  • Produce a product, website, or service that impersonates, passes itself off as, or is likely to cause consumer confusion with any third-party brand, including brands referenced in the website directory.
  • Copy third-party logos, wordmarks, proprietary illustrations, photography, or copyrighted content into your own product.
  • Violate any applicable law, regulation, intellectual property right, or third-party contract.
  • Resell, redistribute, sublicense, or publicly republish the paid deliverables (including DESIGN.md files, preview HTML, either Starter Kit, source files, components, or agent skills) as a standalone product.
  • Attempt to circumvent payment, access controls, or rate limits, or use automated means to scrape the Service.

8. Intellectual Property and Trademarks

Each DESIGN.md is an independent editorial analysis of publicly observable visual patterns; it is not a copy of, derivative work from, or substitute for any third party's design system documentation.

All trademarks, brand names, logos, and product names referenced anywhere on the Service, including in the public website directory and in any generated DESIGN.md, are the property of their respective owners. Their use on the Service is purely nominative, for the purpose of describing visual style patterns that are publicly observable. getdesign.md is not affiliated with, endorsed by, sponsored by, or in any way officially connected with any of the referenced companies.

DESIGN.md files document design tokens (color, type, spacing, layout) inferred from publicly available pages. They do not reproduce third-party logos, copyrighted imagery, or proprietary source code. If you believe a specific directory entry incorporates protected material, see Section 9 for the takedown procedure.

9. Copyright Complaints and Takedown (DMCA-style)

We respect the intellectual property rights of others and respond to clearly substantiated notices of alleged infringement. If you are a rights holder (or authorized agent) and believe content on the Service infringes your rights, send a notice to necati@voltagent.dev that includes:

  • Identification of the copyrighted work or trademark claimed to be infringed.
  • The exact URL(s) of the allegedly infringing material on the Service.
  • Your contact information (name, email, address, phone).
  • A statement that you have a good-faith belief that the use is not authorized.
  • A statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorized to act on their behalf.
  • Your physical or electronic signature.

We aim to review valid notices and, where appropriate, remove or disable access to the identified material within a reasonable time, typically within 10 business days.

10. Indemnification

You agree to defend, indemnify, and hold harmless getdesign.md, the VoltAgent team, and their affiliates, officers, and contractors from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service or any paid deliverable; (b) your violation of these Terms, including the Acceptable Use section; (c) your violation of any third-party right, including any intellectual property, trademark, publicity, or privacy right; or (d) any content or material you submit, including website URLs and additional details.

11. Starter Kit Licenses

Subject to your payment and continued compliance with these Terms, we grant you a perpetual, worldwide, non-exclusive, non-transferable, and non-sublicensable license to use, modify, and deploy the Website Starter Kit or Mobile Starter Kit version delivered to you for:

  • An unlimited number of websites and applications that you, your employer, or your clients own.
  • Personal, internal, commercial, and client projects with an unlimited number of end users.
  • Delivering a customized end product, including its modified source code, to the client for whom you created it.

You may not: (a) redistribute, resell, relicense, or publish a Starter Kit or any separable portion of it — including source files, components, agent skills, playbooks, templates, themes, or effects — as a standalone product, starter, boilerplate, or library; (b) include it in a competing directory, marketplace, starter-kit, or component-library product; (c) share repository or download access with anyone other than team members and contractors working on your licensed projects; (d) remove or obscure copyright or attribution notices included in a Starter Kit; or (e) use a Starter Kit to build a product whose primary purpose is to replicate another company's brand, visual identity, or trade dress.

A client may use the customized end product you deliver to them, but may not extract, reuse, or distribute the underlying Starter Kit as a starter for unrelated projects unless the client obtains a separate license. You retain ownership of your original modifications and content. We retain ownership of the underlying Starter Kits and their first-party source files, UI components, page and screen templates, design systems, agent skills, playbooks, and effects.

Each Starter Kit incorporates third-party open-source software under its respective licenses (for example, MIT, Apache 2.0, or BSD). Those components remain governed by their own licenses, which take precedence over this Section for the components they cover. You are responsible for complying with those licenses, including any required attribution.

Your license to the version delivered to you does not expire. If repository access or product updates are included with your purchase, they are available while we continue to maintain and distribute that product. "Lifetime access" does not promise perpetual hosting, support, compatibility updates, or access to every future product, feature, or service.

12. User Responsibilities

  • You must provide a valid email address and accurate information requested for the product you purchase.
  • You must not use the Service for any unlawful purpose.
  • You are solely responsible for how you use generated DESIGN.md files, preview HTML, and either Starter Kit in your own projects, including reviewing, testing, securing, and validating any changes produced by an AI coding assistant.
  • You must not submit URLs or content that infringe third-party rights or that you are not authorized to submit.
  • You must not include sensitive personal information, confidential business information, or third-party material you are not allowed to share in onboarding or survey responses.
  • For apps built with the Mobile Starter Kit, you are the publisher and are solely responsible for your developer and service-provider accounts, credentials, fees, store listings, privacy disclosures, App Privacy and Data Safety declarations, permissions, account-deletion mechanisms, age ratings, taxes, consumer-law obligations, and compliance with Apple, Google, and other applicable platform rules.
  • You are responsible for the personal data, user-generated content, credentials, and secrets collected or processed by your app. Do not place production secrets in client-side code, prompts, support requests, or materials you are not authorized to share.
  • You allow us to use onboarding and survey responses to operate, improve, and analyze the Service, including creating aggregated or anonymized reports, benchmarks, and public insights. We will not publish individual responses in a way that identifies you without your permission.

13. Account Suspension and Termination

We reserve the right to suspend or terminate your access to the Service, cancel pending orders, and refund or withhold deliverables if we reasonably believe you have violated these Terms (including the Acceptable Use section), engaged in fraudulent or abusive behaviour, or exposed us or third parties to legal risk. Sections that by their nature should survive termination (including Acceptable Use, IP, Indemnification, Kit License restrictions, Disclaimers, Limitation of Liability, and Governing Law) will survive.

14. Disclaimers and Limitation of Liability

The Service and all deliverables are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not guarantee that deliverables will be error-free, complete, uninterrupted, or suitable for any particular purpose.

We do not guarantee approval, publication, ranking, revenue, or continued availability on the Apple App Store, Google Play, or any other platform. Platform policies, operating systems, devices, SDKs, and third-party services may change, and you are responsible for testing and updating your project. We are not responsible for store rejection, third-party service outages or fees, provider policy changes, or the security and lawful processing of data in an app you publish.

To the maximum extent permitted by applicable law, in no event shall getdesign.md, the VoltAgent team, or their operators be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising from or related to the Service or any deliverable, even if advised of the possibility of such damages. Our aggregate liability for any claim arising out of or related to these Terms or the Service will not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or USD $100, whichever is greater.

15. Force Majeure

We are not liable for any delay or failure in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labour disputes, internet or hosting outages, failures or policy changes of third-party services (including Stripe, Supabase, Apple, Google, Expo, RevenueCat, AI providers, and email providers), changes in law, or government action.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware and the federal laws of the United States, without regard to its conflict-of-law principles. The UN Convention on Contracts for the International Sale of Goods does not apply.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be brought exclusively in the state or federal courts located in Delaware, United States, and you consent to the personal jurisdiction of those courts. Nothing in this Section prevents either party from seeking injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.

Any claim must be filed within one (1) year after the cause of action arose, to the extent permitted by applicable law. Consumers residing in the EU or UK retain the benefit of any mandatory consumer protections granted by the laws of their country of residence.

17. Severability and Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full effect. These Terms, together with the Privacy Policy, any order-specific confirmation, and, for Affiliate Program participants, the Affiliate Program Terms, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements on the same subject. The Affiliate Program Terms control only for matters specific to that program.

18. Changes to Terms

These Terms can be updated from time to time as getdesign.md grows. Any meaningful change will be noted here, and using the Service after the update means you accept the new version. Changes to Affiliate Program rates or payment rules apply as described in the Affiliate Program Terms and do not retroactively reduce commissions that were already validated.

19. Affiliate Program

Applying to or participating in the getdesign.md Affiliate Program is subject to the Affiliate Program Terms. Those terms define eligibility, Qualified Sales, referral attribution, advertising disclosures, prohibited conduct, validation, payouts, suspension, and termination.
